Then when he saw the public opinion polls showing 75 of the American people disagreed with that he said Im going to wait until after the November Election.
Clearly this is an admission that he knew the Executive Orders were unpopular and that he knew they would hurt democrats this election cycle Smith said.

If the president is going to issue his Executive Orders (on amnesty) ... and forgive me for being cynical but I look for him to do so a day or two before Thanksgiving or a day or two before Christmas when he knows the media is not paying attention and all the members of Congress are out of town ... hell try to get away with it without paying a political price. But it is still unconstitutional and contrary to his Oath of Office for him to try to change immigration laws himself. He has no legal justification for it ... in fact the president himself has said numerous times over the past couple of years that he has no authority to do it under the Constitution or anything else. Yet now hes talking about trying to make laws himself Smith said. And quite frankly if this war were now involved with in the Middle East becomes more serious I think its going to look very frivolous for him to start giving amnesty to illegal immigrants when he ought to be concentrating on winning the war against the Islamic State said Smith the former chairman of the House Judiciary Committee. The president absolutely must come to Congress that is the law of the land under the War Powers Act ... he has to come to Congress within 60 days of initiating hostilities against foreign enemies and I think the American people want their elected representatives to force the president to come and explain his actions. We all want to know what his goals are how he expects to accomplish those goals how is he going to achieve victory and how is he going to defeat the Islamic State. What is the end game how long is it going to take and when are the troops coming home said the Congressman.The president says he doesnt need to come to Congress that he is going to rely on a resolution passed by Congress in 2001 under a different president that involved different countries Afghanistan & Iraq. I dont often agree with the New York Times but could have written their editorial yesterday when they said the president must go to Congress to get authority Smith said. Youre see a pattern here where the president is ignoring immigration laws hes ignoring laws that involve the War Powers Act hes ignored his own ObamaCare laws hes ignored welfare laws ... where does is stop? This is a presidency out of control.This last week Lois Lerner actually talked to members of the media but still has refused to talk to Committees in Congress. She has taken the 5th Amendment refused to testify on the grounds that she might incriminate herself which says a lot said Smith. But if youre going to talk to the media then come talk to Congress and tell us what you know. If there is any government agency that ought to be above partisanship that ought to believe in equal application of the law and equal justice for all it should be the Department of Justice (DOJ.) And yet this administration has politicized the department has instructed the DOJ not to enforce laws to ignore laws to try and make laws ... and yet such scandals as Fast & Furious the IRS targeting of conservative groups AND their donors have been stopped said Congressman Smith the former chairman of the House Judiciary Committee and now the current chair of the Science Space & Technology Committee. This has been a very partisan Administration a very partisan Department of Justice and thats regrettable.
