Texas Insider Report: WASHINGTON DC U.S. Representative Bill Flores (R-Texas) issued the following statement regarding the U.S. District Courts ruling against the Department of Interiors hydraulic fracturing rule:
Hydraulic fracturing is an integral part of the American energy renaissance and its technological advances have dramatically enhanced Americas energy security. States have been safely and effectively regulating hydraulic fracturing on both government and privately owned lands for decades. Yet the Department of Interior felt it was necessary to circumvent Congress to stifle energy production with its illegal hydraulic fracturing rule. The courts have now ruled and unequivocally affirmed that Congress never gave Interior the authority to regulate hydraulic fracturing. This court ruling is a big win against bureaucratic overreach and for American energy security economic growth and jobs. I applaud the courts decision and I anticipate that we will continue to see more successful legal challenges to the Obama administrations regulatory overreach.

In the 113th Congress Congressman Flores introduced and the House passed with bipartisan support
H.R. 2728 the Protecting States Rights to Promote American Energy Security Act. This legislation prohibits the Department of Interior from enforcing federal hydraulic fracturing regulations in any state that already has regulations and recognizes states authority to regulate this type of activity.
