House Bill 2 to Be Enforced says 5th Circuit Court

General Greg Abbott commend Alliance-for-LifeAUSTIN Texas (Texas Insider Report) We agree that any abortion doctor should have the ability to treat his or her patient at a local hospital in the event of a serious complication said Texas Alliance for Lifes JoeJoe Pojman (right) shortly after the 5th Circuit Court of Appeals suspended a lower courts order in August that completely struck down key provisions of Texas pro-life House Bill 2. This means that the State can immediately enforce the ambulatory surgical center safety regulations and the admitting privileges requirements at abortion facilities across the state while the States appeal of the lower courts rules continues. The appeal of the lower courts order may take many months to complete. Here is a link to the Fifth Circuits opinion. We commend Texas Attorney General Greg Abbott and his legal team headed by Solicitor General Jonathan Mitchell for their effective defense of Texas law from challenges from the abortion industry. We are pleased that the appellate court in New Orleans is allowing the two challenged provisions that increase safety standards at abortion facilities to go into effect. JoeWe also agree that abortion facilities should raise their standard of care to the level of ambulatory surgical centers to ensure that abortions are not performed in a manner that endangers the health and safety of women. Texas women deserve no less. The Legislature passed the new law by wide margins in 2013. While the Supreme Court prohibits state legislatures from banning most abortions states should have the right to protect women from dangerous abortion procedures. That is what the Fifth Circuit has allowed Texas to do.
