January hearing to decide if permanent
Texas Insider Report: AUSTIN, Texas – Late yesterday, the 5th Circuit Court of Appeals overruled a District Court decision blocking provisions of the Pro-Life Omnibus Law from going into effect. Earlier this week, just hours before going into effect, Austin Judge Lee Yeakel blocked one provision, and partially blocked a second provision of the law.
Specifically, Judge Yeakel blocked the provision requiring that doctors performing abortions must have admitting provisions at a nearby hospital, and partially blocked the provision that tightens usage guidelines for the abortion drug RU486.
These provisions would provide common-sense safety precautions for women in our state.
But, the 5th Circuit’s ruling will allow the admitting privileges provision to immediately go into effect. And according to media reports, this means 12 abortions clinics will not be able to perform abortions.
The 5th Circuit will have a hearing in January and then decide whether to permanently strike down Judge Yeakel’s decision.
In addition, uncontested by the Planned Parenthood and ACLU’s lawsuit, is one of the law’s central provisions – the pre-born pain act that stops late-term abortion after 5 months. This provision is now in effect.
In Texas, babies will now be protected from the tremendous pain caused by abortion, women will receive stronger safety protections, and ultimately lives will be saved.
