Sonogram Law: Federal Appeals Court Overturns Injunction Against Texas

width=80A decision made by a Federal Court of Appeals recently will allow Texas to immediately move forward with its sonogram bill in order to empower expecting mothers and protect their unborn children.  Three judges on the 5th Circuit Court of Appeals lifted a temporary stay issued by a district court that ruled Texas new sonogram law as potentially unconstitutional.  Additionally the judges agreed to a request by Texas Attorney General Greg Abbott to allow for the immediate enforcement of this abortion law. The sonogram law passed last legislative session and requires a physician who performs an abortion to play the audio of the fetal heartbeat for the mother to hear and also perform a sonogram on an expectant woman 24 - 72 hours before performing an abortion except in particular cases such as when the mothers life is in danger. This law will give women time to think about the procedure before making a decision about having an abortion. I co-authored this legislation (HB 15) along with approximately 75 of my colleagues in the Texas House of Representatives.  The bill passed with overwhelming support in both the Texas House of Representatives and the Texas Senate and was signed into law by Governor Rick Perry. I believe all women seeking an abortion have the right to receive accurate medical information about the procedure as well as all information available regarding their unborn child. This law will empower women with information and give them time to consider this information in order to make an informed decision about whether or not to have an abortion.
