WOOLLEY: Judge Bert Richardson DROP THE RICK PERRY CASE While You Can

If this case is all about the order of how events occurred... LynnBy Lynn Woolley AUSTIN Texas (Texas Insider Report) The case against Rick Perry has become an embarrassment to Texas and to the states judicial system. The judge in this ill-conceived proceeding now has a technicality to rule on and one that could end the Richardsonfarce immediately. Hed be wise to take advantage of the opportunity to dismiss it.   Prosecutor Michael McCrum (left) took his oath of office then signed an anti-bribery pledge. The Texas Constitution says it MUST be the other way around. McCrumIts a small thing yes. But the entire case against Governor Perry is based on the order of things essentially that Perry said he would veto funding for the Public Integrity Unit before he actually did it. Therefore it is no stretch that Judge Richardson could use this technical glitch to stop the public relations bleeding the state is suffering by bring this absurd case to court. The key here is that the head of the P-I-U in Travis County District Attorney Rosemary Lehmberg was caught drunk behind the wheel. And thats why its unlikely that Perry will ever get convicted of anything. Perrys veto occurred after the DA was arrested drunk taken in for processing and became abusive to deputies. The fact that a drunk abusive DA was heading up a unit with the word integrity" in its name is important. That is a BIG problem for Michael McCrum (at left). McCrumThen there is the constitutional issue of free speech as well as Perrys enumerated powers as governor. He can veto the $7.5 million dollar allocation for the PIU (Public Integrity Unit) if he sees fit. He has the power as governor to do just that. The charges against Perry are based on the order of events. First Perry threatened the veto. Then he exercised the veto. The liberals are saying that constituted a threat. (Some say that Perry was afraid that Lehmberg might have been about to investigate a state cancer fund but that is irrelevant to this case.) So if this case is all about the order of how events occurred Judge Richardson has a chance to end it now. McCrum took his oath and his anti-bribery pledge in the wrong order. As Perrys lawyer Tony Buzbee told the court:
By filing the paperwork wrong McCrum failed to qualify. He cannot act. Game over."
Indeed. In case care where order" matters most the judge should issue an order: Case Closed. lynn Lynn Woolley is a Texas-based syndicated talk-show host and author who blogs at WBDaily.com.
