After the Mid-Terms Will the Constitution Matter?

I’m Lynn Woolley and this is Random Samplings of a Logical Mind

The Constitution has been out of favor for some time now.  Several presidents have decided that they can do as they please with regard to matters of war.  And in the prior six years, both Joe Biden, a Democrat, and Donald Trump, a Republican, took it upon themselves to make momentous decisions without regard to the Congress, or the people.  Joe Biden decided, all by himself, to virtually erase the southern border, and millions poured in, edging the United States toward third-world status.  Donald Trump made a decision to start a war in Iran that seemed unnecessary.  He did not have the support of Congress.  These two presidents virtually destroyed checks and balances, and that may create an opening for the next president to do whatever he or she wants.

Biden unrestrained.
Joe Biden, or his handlers, if you prefer, wasted no time in reversing first-term Trump policies to essentially open up the border and plop a welcome mat all along the Rio Grande.  This is from Wikipedia:  https://en.wikipedia.org/wiki/Immigration_policy_of_the_Biden_administration

On his first day in office, Biden unveiled the U.S. Citizenship Act of 2021, which would provide a pathway to citizenship for as many as 11 million immigrants living in the United States illegally. Upon taking office, Biden moved to dismantle several policies implemented under Donald Trump, halting construction of the Mexico–United States border wall, ending Trump's travel ban on countries with predominantly Muslim populations, and signing an executive order to reaffirm protections for DACA recipients.  The Department of Homeland Security, under the leadership of Alejandro Mayorkas, narrowed the scope of interior immigration enforcement, directing Immigration and Customs Enforcement (ICE) to prioritize national security and violent crime concerns over petty and nonviolent offenses. The administration also attempted to terminate the Remain in Mexico policy.

This, of course, had the effect of opening the border for millions of illegals to enter the country including murderers, Islamists, human traffickers, drug cartels, and potential terrorists.  The Biden administration did this without a vote of the people or the consent of Congress.

Trump unrestrained.
It’s true that presidents have certain powers, especially with regard to sneak attacks like Pearl Harbor or 9/11.  Emergencies happen.  But the Framers of the Constitution gave the power to declare war to the Congress.  That power has eroded over time, partly because presidents were able to nit-pick the language using words such as “operation” and “confrontation” to pretend that acts of war are not really war.  And partly because members of Congress would just as soon let the president take the heat for taking us into war.

The way I read the Constitution is that the power to wage a full-scale war (such as what began in Iran on February 28, 2026) is a duty of Congress to approve.

Article I, Section 8, Clause 11: [The Congress shall have Power . . . ] To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water; . . .

This duty of Congress has been clouded by legislation such as the War Powers Resolution, but the Constitution still is supreme.  Or it used to be.  As you can see, both Biden and Trump did as they pleased with no support of the American people and no passage of a bill by the Congress.

Biden attempted to forgive student loan debt and Trump tore down the East Wing to construct a ballroom at the White House.  Who needs Congress?

These precedents and others create a troubling prospect for future presidents.
Given the fact that the Congress is weakened and does not typically call the hand of a president that assumes extra-Constitutional powers, the door is open for more dangerous shenanigans.  If an open border and an undeclared war are not enough, imagine what could happen if we elect a president that doesn’t like the United States as it has been for 250 years.

Frankly, I worry about Republican presidents, but mainly, my concern is about Democrats.  Virtually all the people that might run for the Republican nomination have respect for the Constitution and rule of law.  Democrats, however, are openly expressing a desire to remake the United States into a completely new type of country.

The Red-Green Alliance between Commission/socialism/Islamism and radical environmentalists  would essentially do away with the Constitution or neuter it.  The rise of the Democratic Socialists of America (currently the base of the Democrat Party) has listed some of its goals.  They include:

  • Abolishing the Electoral College (allowing the large states to pick the president)
  • Packing the Supreme Court to add a sufficient number of left-wing justices
  • Abolishing the United States Senate and possibly the presidency
  • Making Puerto Rico and the District of Columbia states, adding 4 left-wing senators
  • Defunding police and replacing them with social workers
  • Eliminating borders altogether and citizenship for all
  • Replacing Capitalism with a socialist state
  • Implementing Sharia Law in America
  • Installing “Medicare for All” government-controlled healthcare
  • Abolishing or downsizing the United States Armed Forces
  • Eliminating billionaires and redistributing their wealth

These are the requirements to remake the United States into a third-world country in which everyone is miserable, but equal.  This is their definition of “equity.”  There would be no merit-based society, no innovation, and no incentive to succeed since the fruits of your labor would be redistributed.

Who would support this new Islamofascism or Communist-socialist dystopia?
The Democrats have a number of possible candidates that would jump on this bandwagon, led by New York’s DSA-aligned Congresswoman Alexandria Ocasio-Cortez.  If Michigan’s Abdul El-Sayed is able to move up the political ladder, he would support a remaking of America as well, already having promoted “Medicare for All” which would break us financially and destroy our healthcare system.  Former Vice President Kamala Harris and “Mayor” Pete Buttigieg are just as scary, as is Texas State Representative James Talarico.  Vermont Senator Bernie Sanders would be the standard bearer for this movement if he were younger.

We need to return to Clear Moral Objectives.
In 2003, I wrote a book about 12 “objectives” that our country should be promoting.  We have adhered to virtually none of them, and that’s not a good thing.  The final chapter was about a return to the Constitution.  I wrote:

We must declare a reaffirmation of the Constitution and the Bill of Rights as the very basis for our limited government and our precious freedoms.

It was a nice thought.  We’ve done precisely the opposite.  Both Biden and Trump did whatever the hell they wanted, and Congress did nothing more than grumble – if that.  That leaves us in a pickle.  Suppose the next president – on the one after that – is an Islamofascist or a member of the Democratic Socialists of America.  That president might do something to this country that is unthinkable.

That’s why a return to the Constitution is imperative, right now.  Unfortunately, I can yell about it all I want, but there are only 535 people in the United States that can actually make that happen:  the members of both houses of the United States Congress.  If we’ve learned nothing else from Obama, Biden, and Trump, it’s that an unrestrained president has the power to destroy our country.  There are movements afoot that are looking to do that very thing.  They are out in the open, proclaiming what they want to do.

Congress has to grow a backbone and restore the protections of the Constitution, and it may only have a short time to do it.
